TERMS & CONDITIONS


Booking a photo session means that you, the Client and me, the Photographer agree to the session receipt as sent to you via email. This legally binding contract represents the entire understanding of the requirements, schedule and payment terms of a photo session.


PAYMENTS & RETURNS

A £40 deposit is taken on booking. This secures your slot with me. This is a non-refundable deposit and should you cancel for any reason you will lose your deposit. Your £40 deposit is taken off the total amount owing for the session. 


Payment can be made by cash or bank transfer. Payment must be paid by date of photo shoot at the latest. Any photos taken will not be released until payment is made. 


All photographs shall be previewed and downloaded by the Client via an online gallery. Because it is a digital file and not a physical product, unfortunately no returns can be made.


If photographs are unable to be delivered (memory card error, issues outside of human error), a refund will be made or another session scheduled, including 5 extra images in Client’s gallery as compensation. 


CANCELATION

To cancel or reschedule for any reason, Client must give at least 1 week notice. 


No shows are unacceptable and result in loss of my time and earnings for me and will, unfortunately, affect any future bookings with me.


Any late arrival of over 15 minutes will incur a fee of £20. Maximum waiting time is 45 minutes, however if the Client is late to the session, this will be taken off the total time of the session and might affect the amount of received images.


In the event of Perfect Moments Photography is unable to complete the session on the scheduled date due to illness or emergency, Client will be allowed to choose either a refund of deposit, a rescheduled session, or a substitute photographer if they are available at the time. 


LIABILITY

The Client remains responsible for any children or adults which attend the session with them. As I use expensive equipment during my sessions, should the Client or any guest who came with the Client, break or damage any property, the Client is responsible for reimbursing the cost of replacement or repair of any equipment damaged.


COPYRIGHT

All photographs are and shall remain the sole intellectual property of Photographer. Please do not amend, crop or change any aspect of your images. The Client has printing right on any digital photographs purchased and can upload any of the images on social media.


SESSION

The images on this site are from a large number of sessions and it is not possible to offer every pose or set up in each session. Every session is unique to each client. If a particular pose, prop or photo is wanted, the Client will discuss any requests before the day of the session.


The Photographer will make every effort to comply with requests for specific photos. However, this will be dependant on the willingness/co-operation of subjects, it may not be possible for all or any of the images requested or expected to be captured.


In the event of an unsettled baby, some requested props or poses may not be suitable and the Photographer will use alternative props or poses. Please note, not all poses and shots are guaranteed.


The Photographer will end the session at her discretion when it is determined that adequate images in terms of quality and quantity have been captured. There will be no refund or credit for unused time.


The Photographer will do everything she can to produce good quality images. However, if your baby won’t settle or co-operate resulting in little or no images taken then the Photographer cannot be held responsible. In this instance the Photographer will offer the chance to re-shoot at a time suitable for both parties, although for newborn sessions it cannot be guaranteed that it will be in the 2 weeks time frame.


If Client is taken ill by an infectious disease, they must let me know and rearrange their session until they are fully recovered and no longer contagious. This is to protect the health of all my clients, who often include newborns.


Client must inform me on booking if anyone attending photography session suffers from any health conditions including allergies, photosensitive epilepsy, medical issues, physical difficulties and disabilities etc.


The Client is responsible for the children's safety during the photography session. The Client must therefore ensure that a responsible adult, other than the Photographer, is present at all times to supervise the children.


The Photographers camera is the only camera allowed at the photo session unless otherwise agreed with the Photographer. 


DELIVERY

Proofing gallery with unedited images will be released 3-7 working days after photoshoot. All images will be protected with watermarks as they are released only for selection purpose. After selection is made - proofing gallery will be deleted.

 

Proofing gallery is valid for 7 days and if selection is not made by then, Photographer will choose which images to edit.


Final images will be delivered to the Client via an online gallery up to maximum 20 working days after selection is made. 

 

Waiting time for prints (photo prints, albums, wall arts etc) is up to 45 working days after selection is made.


Prints and other photo purchases need to be collected by the Client. In cases where the Client wants their photo purchases to be posted - there is an extra charge of £5 (prints) or £10 (larger items such as albums, wall art etc)


Clients to be informed via e-mail when prints and photo products are ready for collection. Prints are available to be collected for 1 month from when they are ready. If they aren’t collected during this time, the only option will be by arranging the postage. If postage isn’t arranged within 6 months prints will be disposed off.


It is the Client's responsibility to check the quality of prints, albums, wall arts and usb memory sticks once they have received them. Any complaints can be raised up to 48 hours from when Client received the items.


The online gallery will be available for 3 months time from release date. 

 

RAW / unedited images are not included in packages. If Clients would like to buy unedited pictures, there is a possibility however they are priced as the edited version.


Perfect Moments Photography does not take any responsibility for the quality and colour accuracy of prints/products bought somewhere else.


EDITING


The chosen images will be edited in the photographer's style, consistent with their portfolio. Additional specific editing requests by Client can be accommodated at the Photographers discretion. If extensive edits are requested, they will be priced at £5 per picture. 


If there is anything in the editing that the Client doesn’t like, they are welcome to point it out and the photos may be reedited.


If Client chose the photo that turned out to be poor quality / blurred, Perfect Moments will edit similar photo instead. If there are no similar photos in RAW gallery (same pose & lighting) Perfect Moments will ask Client to choose different picture instead. 


GIFT VOUCHERS

Gift vouchers purchased from Perfect Moments are only valid for 12 months from date of purchase.


Gift vouchers cannot be exchanged for cash and are non transferable. No refunds will be given.


MODEL RELEASE

Being able to share the photographs I capture is an essential part of running a photography business – after all, seeing my work is usually one of the main reasons clients book me.


In fact, it’s so vital that in return for your full image permissions release below, you’ll receive one extra photo from your session.


I provide consent for images captured by Perfect Moment to be used for:

Photography qualifications and awards - Yes/No

Perfect Moments Portfolio & Website - Yes/No

Business promotion (e.g. leaflets, brochures, adverts, postcards etc) - Yes/No

Social Media (e.g. a sneak peek from your shoot on Instagram & Facebook) - Yes/No


APPROVAL

By booking with Katarzyna Simpkins the Client agrees to the terms listed above.
